General Terms and Conditions (GTC) of Edge2 Summits Trekking Guide

1 Scope of Application

These General Terms of Conditions (hereinafter“GTC”) apply to Edge2 Summits Trekking Guide (hereinafter“Organizer”). They regulate the relationship between the Organizer and each natural person (hereinafter “Participant”) who uses the services of the Organizer.

2 Registration/conclusion of contract

Registration is possible at any time and can be done in writing, electronically, by phone or in person directly with the Organizer. By registering for a booked tour, a binding contract is concluded between the Participant and the Organizer. By registering, the Participant also accepts these GTC as an essential part of the contract between themselves and the Organizer. The Participant is responsible for providing the Organizer with correct personal data and for checking all details provided on the booking form/invoice. Any irregularities must be reported to the Organizer immediately.

​3 Prices

All prices are gross in JPY including guiding fee, guide expenses and consumption tax. Prices are expressly subject to change. The prices do not include return transport between the guests place of residence and the agreed starting point of the tour and no services of a personal nature (e.g. telephone calls, drinks, tips, meals and the like) unless expressly stated. The Participant undertakes to pay the contractually agreed price to the Organizer. Additional services may be provided in agreement with the Organizer. Any additional costs incurred as a result shall be borne by the Participant.

4 Terms of payment

The total amount is to be paid by online payment within 5 days from the day following the day on which the Organizer notify the Participant of the acceptance of the registration. If payment is not made within this period, the Organizer reserves the right to withhold its services or to withdraw from the contract.

5 Cancellation or change of booking by the Participant

In the event of a total cancellation of the tour, the Participant will be charged the following proportion of the total costs as per the booking confirmation.
30 to 10 days before tour start date : 10%
9 to 5 days before tour start date : 30%
4 to 2 days before tour start date : 50%
The day before tour start date : 80%
The day of tour or no-show : 100%

6 Program changes by the Participant

In the event of late arrival or early departure by the Participant, no refund shall be issued. Additional costs incurred due to late arrival, early departure or postponement of the tour shall be borne by the Participant. If the Participant postpones the tour, he/she shall be charged costs as per the above cancellation conditions.

7 Cancellation or change of program by the Organizer

7.1 Non-compliance with instructions and lack of ability to participate

The tour can be cancelled at short notice by the Organizer if Participants give cause to believe, through their behavior or omissions before or during the tour, that the fulfilment of the contract is endangered or made impossible or if the tour has to be cancelled or changed due to illness or lack of fitness of the Participant. The Participant is not entitled to a refund.

7.2 Force majeure

If a tour cannot be carried out due to force majeure, safety concerns on the part of the Organizer, official measures, strike, non-operation of the public transportation or uncertain weather or natural conditions such as major earthquakes, volcanic eruptions, tsunamis, the Organizer is entitled to cancel or interrupt the tour, even at short notice, without any obligation to pay compensation. Cancellations will be communicated to the Participant immediately. The Organizer is also entitled to move the course location or to modify the booked program with an alternative tour.

​7.3 Substantial change of contract

If there is a significant change to a major point on the contract before the start of the tour, or if a change to the program leads to a price increase of more than 10%, the Participant can withdraw from the contract. Payments already made in accordance with the booking confirmation will be refund to the Participant. There are no refunds for program changes after departure.

8 Health

Good health is required for all Organizer’s tours. The Participant is obliged to inform the Organizer about any health problems. In particular the following health conditions exclude participation in the tour: eye surgery, high blood pressure, chronic ear diseases with balance problems, heart problems, epilepsy, increased risk in the cardiovascular system, neurological problems, whiplash and pregnancy. Under no circumstances may the Participant be under the influence of drugs, alcohol or psychotropic drugs or similar. If the activity has to be terminated early due to lack of fitness of the Participant or inappropriate equipment (especially own equipment brought by the Participant), all claims for reimbursement will be forfeited.

​9 Organizer’s instructions

The participant shall meet the conditions of participation and strictly follow the Organizer’s instructions. In the event of non-compliance with the conditions of participation or failure to follow the instructions, the Organizer may exclude the Participant from the tour. No refund will be made in such cases.

10 Age

Participants under 18 years of age need the consent of their legal guardian to participate in the tour.

11 Waiver of liability and insurance

The Organizer may require the signing of a waiver as a condition of participation for certain tours. This document is intended to be a legally binding agreement that in the event of certain events, including loss, injury, damage or death, the Participant will not hold the Organizer liable.
The Participant is not insured by the Organizer. Each Participant is independently responsible for taking out all necessary insurances (especially health, accident, property and cancellation insurance and insurance for mountaineering).

12 Complaints

In the event that the Participant has grievances or incurs damages, they are required to report these issues promptly to the Organizer for acknowledgment. It should be noted that while the Organizer will confirm receipt of the complaint, this does not equate to an admission of liability.
The Organizer will strive to address and rectify the issue to the best of their ability within the constraints of the event and available resources. If the remedial actions taken are deemed unsatisfactory or insufficient, or if the Participant intends to pursue damage claims, he/she must formally submit the claim in writing with supporting evidence to the Organizer, within four weeks following the contractual end date of the tour.
Failure to report grievances during the tour or to submit the claim with supporting evidence to the Organizer within the stipulated timeframe will result in the forfeiture of all claims.

13 Liability

Claims for damages are excluded unless resulting from intent or gross negligence. If the Participant does not follow the instructions of the Organizer, the Organizer shall not be liable.
In particular, the Organizer shall not be liable for damages caused by third parties, other participants, force majeure such as natural events, official orders.

14 Participant’s liability

In the event that the Organizer suffer damages due to the Participant’s intentional or negligent act, the Organizer will claim compensation for damages to the Participant.

15 Personal data protection

The Organizer respects all Participant’s privacy by undertaking personal data protection law and any applicable foreign data protection law. The Organizer processes Participant’s personal data such as name, telephone number, address, e-mail address, age, gender and any other data that Participant provide the Organizer when registering, primarily for the fulfilment of contractual obligations as well as for the fulfilment of legal obligations imposed on the Organizer.
The Organizer will retain the above personal data for as long as necessary or appropriate to comply with applicable laws or with the purposes for which they were collected. The Organizer delete these personal data as soon as they are no longer required and in any case after the maximum retention period required by law has expired.
The Organizer will transfer Participant’s personal data to a third party only if the Participant have expressly consented, if there is a legal obligation to do so, if such transfer is necessary to enforce the Organizer’s rights or assert claims arising from the contractual relationship with Participants, or if necessary for the execution of the contract.

16 Applicable law and place of jurisdiction

The contractual relationship is subject to Japan law exclusively. The parties agree that the exclusive place of jurisdiction shall be the Tokyo District Court.

17 Amendments

The Organizer reserves the right to change these GTC at any time. The GTC valid at the time of conclusion of the contract shall apply.

Payment

After booking and adjustment of the contents of the tour, please make payment as per the agreement.

Insurance of Trekking

We strongly recommend that all participants in the Edge2 Summit tour take out mountaineering accident insurance in case of an emergency.

This is the mountaineering insurance we recommend. Both types of insurance are available as annual insurance or short-term insurance for the duration of your mountaineering trip.
