General Terms and Conditions (GTC) of Edge2 Summits Trekking Guide

1 Scope of Application

These General Terms and Conditions (hereinafter the “GTC”) apply to Edge2 Summits Trekking Guide (hereinafter the “Organizer”). They regulate the relationship between the Organizer and each natural person (hereinafter the “Participant”) who uses the trekking and mountain guiding services provided by the Organizer.

2 Registration and Conclusion of Contract

Registration is possible at any time and may be made in writing, electronically, by telephone, or in person directly with the Organizer.

A binding contract between the Participant and the Organizer is concluded when the Organizer confirms acceptance of the Participant’s registration in writing.

By registering for a tour, the Participant agrees to these GTC as an integral part of the contract.

The Participant is responsible for providing accurate personal information and for checking all details stated in the booking confirmation or invoice. Any errors or irregularities must be reported to the Organizer immediately.

​3 Prices

All prices are gross amounts in Japanese Yen (JPY) and include the guiding fee, the Organizer’s guiding expenses, and applicable consumption tax, unless otherwise stated.

Prices are subject to change until the booking has been confirmed by the Organizer.

Unless expressly stated otherwise, prices do not include transportation between the Participant’s place of residence and the agreed starting point of the tour, accommodation, mountain-hut charges, meals, drinks, telephone calls, tips, personal equipment, or other personal expenses.

Costs for services provided by third parties, such as mountain huts, public transportation, accommodation, or other external service providers, are payable by the Participant unless expressly included in the agreed tour price.

Any additional services requested by the Participant must be agreed with the Organizer in advance. Any additional costs arising from such services shall be borne by the Participant.

4 Deposit and Terms of Payment

If the total tour price is JPY 50,000 or more, the Organizer may require a deposit of 10% of the total tour price.

Where a deposit is required, the Organizer will make reservations for mountain huts, accommodation, transportation, or other third-party services only after the deposit has been received.

The remaining balance shall be paid by online payment within five days from the day following the date on which the Organizer notifies the Participant of acceptance of the registration, unless otherwise agreed in writing.

If payment is not received within the specified period, the Organizer reserves the right to withhold its services, cancel any provisional reservations, or withdraw from the contract.

The deposit is part of the total tour price and will be deducted from the final balance.

5 Cancellation or Change of Booking by the Participant

In the event of a total cancellation of the tour, the Participant will be charged the following cancellation fees will apply to the total tour price.

More than 30 days before the tour start date: No cancellation fee
30 to 10 days before the tour start date: 10%
9 to 5 days before the tour start date: 30%
4 to 2 days before the tour start date: 50%
The day before the tour start date: 80%
The day of the tour or no-show: 100%

If the Participant has already paid an amount exceeding the applicable cancellation fee, the difference will be refunded.

Any refund will be made by the Organizer using the payment method or bank transfer method reasonably available to the Organizer. Any bank transfer, payment processing, or other transaction fees incurred in connection with a refund shall be borne by the Participant and may be deducted from the refund amount.

If any third-party cancellation fees or non-refundable costs have already been incurred, these costs may also be deducted from the amount to be refunded, where applicable.

​6 Late Arrival, Early Departure or Postponement by the Participant

In the event of late arrival or early departure by the Participant, no refund will be made for services that cannot be provided as a result.

Any additional costs caused by late arrival, early departure, or postponement of the tour shall be borne by the Participant.

If the Participant requests postponement of the tour, the Organizer will consider the request subject to availability, weather, seasonal conditions, and other circumstances. Any cancellation or postponement costs already incurred will be charged to the Participant in accordance with the applicable cancellation conditions and third-party terms.

7 Cancellation or change of program by the Organizer

7.1 Non-compliance with instructions and lack of ability to participate

The Organizer may cancel or terminate the tour if, before or during the tour, the Participant’s behavior, physical condition, equipment, or other circumstances give reasonable cause to believe that the safe and proper conduct of the tour is endangered or made impossible.

This includes situations where the Participant is unable to safely participate because of insufficient fitness, inappropriate equipment, or failure to comply with the conditions of participation.

Where cancellation or termination is caused by the Participant’s own circumstances or actions, the Participant will not be entitled to a refund for services that cannot be provided.

7.2 Force majeure, Weather and Safety

The Organizer may cancel, interrupt, postpone, or modify a tour, even at short notice, when this is reasonably necessary for safety or because of circumstances beyond the Organizer’s reasonable control.

Such circumstances may include severe or uncertain weather conditions, snow or ice conditions, avalanches, landslides, earthquakes, volcanic eruptions, tsunamis, official orders or restrictions, strikes, closure or non-operation of public transportation, closure of mountain huts, trail closures, or other natural or external events.

In such circumstances, the Organizer may change the route, destination, tour dates, meeting point, or other elements of the program and may propose a suitable alternative tour.

Where the tour is cancelled before departure and the Organizer is unable to provide an appropriate alternative, the Organizer will refund payments received for services that have not been provided, after deduction of any non-refundable costs already incurred on behalf of the Participant.

No additional compensation for consequential losses, travel expenses, accommodation, or other personal expenses will be payable by the Organizer, except where required by applicable law.

​7.3 Substantial Change of Contract

If, before the start of the tour, there is a substantial change to a major element of the agreed tour, or if a change to the program results in a price increase of more than 10%, the Participant may withdraw from the contract.

In such a case, payments already made for services that will not be provided will be refunded, subject to any non-refundable third-party costs already incurred on behalf of the Participant.

There will be no refund for changes to the program made after the tour has commenced, except where otherwise required by applicable law.

8 Health and Fitness

The Participant must be in sufficiently good physical and mental condition to safely participate in the booked tour.

The Participant is obliged to inform the Organizer in advance of any medical condition, medication, physical limitation, or other circumstance that may affect their ability to safely participate in the tour.

The Organizer may refuse participation or modify the proposed route if, based on the information available, the Organizer reasonably considers that participation would pose an unacceptable safety risk to the Participant or others.

Participants must not participate while under the influence of illegal drugs, alcohol, or other substances that may impair judgment, coordination, or physical ability.

If the tour has to be terminated early because of the Participant’s lack of fitness, inappropriate equipment, or other circumstances attributable to the Participant, the Participant will not be entitled to a refund for services that cannot be provided. Any additional costs arising from such circumstances shall be borne by the Participant.

​9 Organizer’s instructions

The Participant must comply with the conditions of participation and follow the reasonable safety instructions of the Organizer at all times.

The Organizer may exclude a Participant from the tour if the Participant seriously or repeatedly fails to follow safety instructions or otherwise behaves in a manner that endangers themselves, the Organizer, or other participants.

In such cases, the Participant will not be entitled to a refund for services that cannot be provided.

10 Age

Participants under 18 years of age require the consent of their legal guardian to participate in a tour.

The Organizer may impose additional participation requirements or refuse participation where necessary for safety reasons.

11 Liability Waiver and Insurance

For certain tours, the Organizer may require the Participant to sign a separate waiver or participation agreement as a condition of participation.

Such a waiver may address risks inherent in trekking, hiking, mountain activities, changing weather and natural conditions, and other risks associated with participation. Any such waiver shall apply only to the extent permitted by applicable law.

The Participant acknowledges that trekking and mountain activities involve inherent risks, including but not limited to falls, slips, rockfall, snow and ice, adverse weather, altitude, natural hazards, encounters with wildlife, and changes in trail conditions.

The Participant is not insured by the Organizer.

Each Participant is responsible for obtaining appropriate insurance covering, as applicable, medical expenses, accidents, rescue and evacuation, personal belongings, trip cancellation, and mountain or trekking activities.

Participants from outside Japan are strongly advised to ensure that their insurance provides adequate coverage for mountain rescue and emergency evacuation in Jap

12 Complaints

If the Participant has any complaint or believes that damage or loss has occurred during the tour, the Participant should report the matter to the Organizer as soon as reasonably possible so that the Organizer has an opportunity to investigate and, where possible, remedy the situation during the tour.

Acknowledgement of a complaint by the Organizer does not constitute an admission of liability.

If the Participant considers the remedial action to be insufficient or intends to make a claim for damages, the claim should be submitted to the Organizer in writing, together with relevant supporting evidence, within four weeks after the contractual end date of the tour, unless a longer period is required by applicable law.

Failure to report a complaint promptly may limit the Organizer’s ability to investigate or remedy the matter.

13 Liability

The Organizer shall be liable for damage caused by the Organizer’s intentional or grossly negligent acts or omissions, subject to applicable law.

To the extent permitted by applicable law, the Organizer shall not be liable for losses or damage arising from circumstances beyond the Organizer’s reasonable control, including natural events, weather conditions, official orders, transportation disruptions, mountain-hut closures, or acts or omissions of third parties.

The Organizer shall not be liable for consequences arising from the Participant’s failure to follow reasonable safety instructions, failure to disclose relevant health or fitness information, or use of inappropriate or inadequate personal equipment.

Nothing in these GTC shall exclude or limit liability to the extent that such exclusion or limitation is prohibited by applicable law.

14 Participant’s liability

The Participant shall be responsible for damage caused to the Organizer or third parties by the Participant’s intentional or negligent acts or omissions.

The Participant shall also be responsible for additional costs arising from the Participant’
s failure to follow the conditions of participation or reasonable safety instructions, where such costs are attributable to the Participant.

15 Personal Data Protection

The Organizer respects the privacy of Participants and complies with applicable Japanese personal data protection laws and, where applicable, relevant foreign data protection laws.

The Organizer processes personal data such as the Participant’s name, telephone number, address, email address, age, gender, emergency contact information, and other information provided by the Participant primarily for the performance of the contract, safety management, communication, and compliance with legal obligations.

The Organizer will retain personal data only for as long as reasonably necessary to fulfil the purposes for which it was collected or to comply with applicable legal obligations.

The Organizer will delete or securely dispose of personal data when it is no longer required, subject to applicable legal retention requirements.

The Organizer may provide Participant information to third parties where this is necessary for the performance of the contract, such as mountain huts, accommodation providers, transportation providers, emergency services, insurance providers, or other service providers, or where required or permitted by applicable law.

The Organizer will not use Participant information for unrelated purposes without the Participant’
s consent, except where permitted or required by applicable law.

16 Applicable Law and Jurisdiction

The contractual relationship shall be governed exclusively by the laws of Japan.

The parties agree that the Tokyo District Court shall have jurisdiction over disputes arising from or relating to the contractual relationship, to the extent permitted by applicable law.

17 Amendments

The Organizer reserves the right to amend these GTC from time to time.

The version of the GTC accepted by the Participant at the time of conclusion of the contract shall apply to that contract, unless otherwise agreed in writing or required by applicable law.
